TIME TO HAVE A TALK WITH THE PARENTS

Today I spent a part of my morning being a witness. Having been duly sworn, I witnessed a client sign a will and a healthcare power of attorney. These documents were drafted by my law partner, Adam Draper.
At Draper & Wagner, PC, we believe that nearly everyone will eventually need these documents. This goes for a durable power of attorney, and perhaps a living will, too. These documents are important and very beneficial to our families; and without these documents, the lives of our families could be made very difficult.


The real question is when is the right time?


Certainly, when I was much younger, and my wife and I had our first child, we executed a will because it was the right time for us. We executed the will in such a way that it did not need to be revised each time a new child entered our family. However, after few decades and with grown children, the will has been revised.
Years ago, when I executed my first will, I did not have a living will nor a healthcare power of attorney nor a durable power of attorney. I am now in my mid-fifties, and life has surely changed in the passing years. I have taken the steps necessary for planning my estate, particularly to prepare for what might happen I become ill and I am no longer able to make my own decisions concerning my healthcare.
In processing what do do about my wife and kids, it struck me: what about my parents? Have they changed their will since I was a child? Have they executed a durable power of attorney? Does someone have a healthcare power of attorney?
It is a conversation that I plan on having this weekend with my parents, perhaps you should as well.
